(hereinafter, MAR ABIERTO), Apartamentos Lago Taurito, Urbanización Taurito, C.P. 35138 Mogán, makes available to internet users.

The use of the Site confers the condition of user (the “user”) and implies unreserved full accceptance of all the terms and conditions contained in this Legal Notice in the version published by MAR ABIERTO when the user accesses the Site. Therefore, we recommend ou to read carefully the Legal Notice each time you access the Site, since it may suffer modifications.

The use and of and/or access to the services or contents may be sunject to specific conditions (hereinafter, the “Specific Conditions”), which may be replace, complete and/or modify this Legal Notice. In the event that any of the General Conditions of the Legal Notice is declared tobe null, void or ineffectice, this will not affect the validity or effectiveness of the remaining conditions, which will continue to be binding for the parties. 2. PURPOSE

Though the Site, MAR ABIERTO provides the users information, applications, access to and/or use of the services or contents (the “Services”) developed or made available under the terms set for in each case. MAR ABIERTO allows any citizen, company, entity and, in general, any interested party to get informed, interact, take part in and access the services and initiatives in a flexible and permanet manner.

1. INFORMATION DUTY, PURPOSE, PERSONAL DATA PROTECTION.

The present document (hereinafter, the “Privay Policy”) regulates the privacy policy of the “www.hotelrurallastirajanas.com” web site (hereinafter, the “Site”) that MAR ABIERTO S.L. (hereinafter, MAR ABIERTO), Apartamentos Lago Taurito, Urbanización Taurito, C.P. 35138 Mogán, makes available to internet users.

Pursuant to the provisions of Art. of the Organic Law 15/1999, of December 13, on Personal Data Protection (LOPD), MAR ABIERTO informs the Site users that it keeps data files with personal data of users and/or candidates who, freely and voluntarily, wish to contribute their peresonal data for effective access to the contents, employment oportunities and provision of services available at the Site, as well as for the proccessing of any requests or inquiries.

Except otherwise stated, it will be necessary to complete all the mandatory information marked as such in the various forms available at the Site. In case the user does not provide all the data required, MAR ABIERTO may freely decide not to proceed to register the user, in an applicable case, or else to deny access to the Site contents, services or transactions.

The user must fill in the forms contained in the Site with true, accurate and updated data, and will be responsible for any damages caused to MAR ABIERTO or to any third party as a result of the user’s no-compliance of these requirements.

If you are under 18 years of age, you need to have the prior consent of your legal representatives, either your parents or your guardians, before procceding to include your data in the Site data forms, without prejuice to the provisions of art. 13 of the Regulations 1720/2007, of December 21, which approved the Regulations for the Implementation of the LOPD (jereinafter, the RDLOPD).

2. INCUMBENT’S CONSENT.

The recording of the user’s personal data provided through the use of the e-forms available at the Site, by the remittance of email or anyother comunications sent to MAR ABIERTO through electronic and/or data transmission means, implies, except where otherwhise expressly stated, the sender’s cpmsemt tp the processing or handling of the data included in the above.mentioned media, in accordance with the purposes stated in the web or associated to the personal data files of MAR ABIERTO to which these are incorporated, all of this in consistence with the requests and/or comments raised by users.

In the legal cases of disclosure or assigment of data pursuant tothe regulations of the LOPD, the user is hereby informed that their data might be accessed by third parties providing services to MAR ABIERTO, for these to be able to provide such services or perform eventual processing requests/commitments. For your safety and in order to respect your rights, this latter possibility will be articulated, in all cases, in accordance with the provisions of article 12 of the LOPD and the other concordant provisions of the RDLOPD.

Terms of use.

Access to and/or use of the Site by users will be free of charge, without prejuice to the remunerated or rated nature of the services or transactions requested.

2. BROWSING AND DATA FORMS.

In general, the access to or the browsing through the Site does not require the user’s prior subscription or registration. Notwithstanding, MAR ABIERTO may condition the provision of its services or the access to certain contents offered to the prior completion of the correponding data form.

MAR ABIERTO reserves the right to modify unilaterally at any time the system or the data forms provided at the Site.

3. VERACITY OF THE INFORMATION.

All informtation provided by users in the forms must be accurate, current and true.

The user represents the veracity of the information provided when completing the forms for access or for the processing of services or inquiries. The user will be the sole responsible for keeping all the onformation provided to MAR ABIERTO permanently updated as appropiate, at each time, to the user’s current status. The user will be the sole responsible for any false or inaccurate representations made by the user and for any damages caused to MAR ABIERTO or to htird parties by the information provided by the user.

4. MINORS.

To use the services, minors must obtain the prior consent of their parents, guardians or legal representatives, who shall be deemed responsible for all acts done by the minors under their charge or represented by them.
